Purposes and legal basis of processing and duration of storage

We process personal data for various purposes. Generally speaking, the personal data of the data subject are stored as long as the purpose exists

General access to our website and service

With each access to our website and online services, we automatically collect data and information from the accessing device and store this data and information in the log files of the server. We may collect (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (known as referrers), (4) the sub-web pages that are accessed on our website (5) the date and time of access to the website, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information used to defend any attacks against our IT systems. For security purposes, i.e. to be able to reconstruct an eventual attack against our Platforms, we store such data including the IP address for 14 days and then anonymize or delete such data. The IP address is required during the connection to transfer the contents of our Platform to your device. The legal basis for the processing and storage of the IP address is a legitimate interest as per Article 6 (1) (f) GDPR. The legitimate interest for the transmission of the IP address is that it is required to display the contents of the websites; without transmission of the IP address it is not possible to display such content. The legitimate interest for the temporary storage is our security interests.

Systems we provide to our Partners

We provide various systems to the Partners of the Network. These are:

Within these systems we process personal data of the employees of our Partners. The categories of personal data we process are account data to use the systems, content data (i.e. data that is stored in the systems by the partners or their employees, respectively) and log files. The purpose of such processing is that the employees of our Partners can use the services provided by us on behalf of the respective Partner as the employer of the respective employee. The legal basis for the processing is a legitimate interest as per Article 6 (1) (f) GDPR, i.e. to provide our services to our Partners. Such interest is not overridden by the Partners’ employees, because the processing is already necessary for the performance of the contract between the respective Partner and its employee. We store the data in these systems as long as the respective accounts of the Partner’s employee exists. The employee can terminate the accounts at any time.

Services we provide to us and our Partner’s customers

We provide a system to us and our Partners’ customers through which these can control the services provided by us and our Partners at https://flashpost.the-network.com/. In that context we process personal data of the employees of our and our Partners’ customers, namely account data, content data (i.e. data that is stored in the systems by the partners or their employees, respectively) and log files. The purpose of such processing is that our and our Partners’ customers can use the services provided by us and our Partners. The legal basis for the processing is a legitimate interest as per Article 6 (1) (f) GDPR, i.e. to provide our and our Partners’ services to the respective customers. Such interest is not overridden by the customers’ employees, because the processing is already necessary for the performance of the contract between the respective customer and its employee. We store the data in that system as long as the account of the customer’s employee exists. The employee can terminate the account at any time.

Global Talent Survey

We organize a global talent survey. You can find the details at https://www.the-network.com/globaltalentsurvey/. It provides quality data on current mobility trends, job preferences, and other workforce information and empowers companies to understand labor markets as well as sought-for professionals, taking the guesswork out of recruiting, enabling better results with fewer resources. If you participate in the survey, we will create an account for you and process account details and your eventual responses to the survey. You can request registration to participate in the survey at https://www.the-network.com/register/?lead=lead. We will transmit your request for registration to the Network Partner(s) in your countries to decide about the registration. We provide a contact form at the-network.com/contact/ that can be used to contact us electronically. By clicking the “Submit Query” button, you consent to the transmission to us of the data entered in the form. In addition, we save the date and time of your contact. Alternatively, contact via the e-mail address provided is possible. The legal basis for the transmission of the data is Art. 6 (1) (a) GDPR. The data will be used for this purpose until the specific conversation with you has ended. The conversation will be deemed ended when it can be inferred from the circumstances that the relevant facts have been conclusively clarified. Please note that we furthermore store conversations, that are business correspondence, for the duration of six years, in order to comply with statutory retention periods for business correspondence under section 257 (1) no. 2 German Commercial Code (HGB) and section 147 German Tax Code (AO), whereby the term begins at the end of the calendar year in which the correspondence was sent or received or the accounting record came into existence. The legal basis for this purpose is Art. 6 (1) (c) of the GDPR.

Data processing for contract management and pre-contractual purposes

We process personal data for the purpose of contract management, that is, so that we can provide our customers with the contractual services and also for associated pre-contractual purposes. If the customer is a natural person, the legal basis is that the processing is required for the performance of a contract or for the performance of pre-contractual measures pursuant to Art. 6 (1) sentence 1 b GDPR. If we process personal data of employees of the customer, the legal basis is a legitimate interest pursuant to Art. 6 (1) sentence 1 f GDPR. The legitimate interest lies in the conduct of our business and that of the customer. There is no conflicting interest of the data subject because, from the point of view of our customer, we are required to perform the processing in the context of the existing employment relationship with the data subject. We store personal data for this purpose for the term of the contract. Furthermore, we store accounting records for the duration of ten years and business correspondence for the duration of six years, in order to comply with statutory retention periods for business correspondence under section 257 (1) no. 2 German Commercial Code (HGB) and section 147 German Tax Code (AO), whereby the term begins at the end of the calendar year in which the correspondence was sent or received or the accounting record came into existence. The legal basis for this purpose is Art. 6 (1) (c) GDPR.

Recipients or categories of recipients of personal data

We use data processors, particularly host providers. These may therefore receive personal data. Furthermore, we may also transmit or provide data to third parties within the scope of your consent or a contract with you, as described in section 2.

Transfer of data to countries outside the EU or the EEA

In certain cases, we transfer personal information to countries outside the EU or the EEA (so-called third countries). Essentially, this can be the case if you are requesting information or services from a Partner in a third country. Please note that such countries might have a lower level of data protection.

Duration for which personal data is stored

Generally speaking, personal data is stored as long as the purpose exists. The individual storage periods have been set out above in section 2

Rights of data subjects

You have various rights related to the processing of personal data. You have (depending on the circumstances) the right to request access to  the personal data (Article 15 GDPR), to rectification (Article 16 DGVO) or erasure(Article 17 GDPR), to restriction of processing (Article 18 GDPR), a right to object (Art. 21 DSGVO) and a right to data portability (Art. 20 DSGVO). If the processing is based on a consent, you can withdraw it at any time.

If you believe that the processing of your personal data is in violation of the GDPR, you have the right to complain to a supervisory authority.

Is there an obligation to provide personal information?

The provision of personal data is neither required by law nor by contract, nor are you required to provide personal information. However, the provision of personal data for the use of our services may be required to use the services we or our Partners provide. In other words, if you do not provide us with the information, we specify to be necessary, we and/or our Partners may not be able to provide you with the full scope of services.

Modification of the privacy policy; change of purpose
